Regular Voluntary Overtime Annual Leave Pay

In order to comply with legislation, from 1 January 2019 regular voluntary overtime needs to be reflected in employee’s holiday pay.

This is being managed according to your contract type therefore please familiarise yourself with the below information and associated documents.

If you don’t currently utilise one of KCC's payroll systems via SPS IntePay, you are required to liaise with your payroll provider to confirm that their operations are ensuring compliance with the legislation. For any queries please contact your provider directly.

Where it is deemed that overtime has been regularly worked (in line with the procedure) managers will be alerted and if the relevant employees take annual leave in the current month a calculation is required. Schools and Academies will receive alerts and reports by the 15th of each month with the first report being provided in February 2019.

To support with the calculation, a calculator tool (XLSM, 41.7 KB) can be located on Kelsi for managers to use. The calculated hours will then need to be entered via the normal submission process of additional hours or overtime for your payroll provider.

Term Time Only Staff

When staff on a term time only contract work extra hours or overtime a calculation will be completed through the payroll system to reflect the legislation. Staff will then be paid an enhancement automatically through payroll. No further management action is required. The first payments will be made through the February 2019 payroll to ensure retrospective claims for January are captured.
